Arkansas Motor Vehicle Accidents: Things You Should Know

Before diving into the facts below, you should know that the most important advice after being in a wreck caused by another driver’s negligence is to:

  • Take pictures;
  • Get treated; and
  • Hire an attorney (sooner rather than later so evidence can be preserved).

Fact #1: You Have 3 Years to File A Lawsuit

You have 3 years from the date of the wreck to bring a lawsuit or your claim is forever barred.

It would not be good advice to wait until the 3 years is almost up to bring a claim.

However, it is good to know that prior to filing a lawsuit, you do have ample time to:

  • Hire an attorney;
  • Get medical treatment; and
  • Pursue a claim against the other driver’s insurance company

Fact #2: The 25/50/25 Insurance Policy Requirement

Any vehicle being driven in the State of Arkansas must have a minimum of 25/50/25 insurance policy.

25/50/25 means that the insurance policy must cover up to $25,000 per person injured in an individual car wreck with no more than $50,000 for every person in the wreck and no more than $25,000 for property damage.

That means if there are several people injured in a wreck and the other driver has 25/50/25 coverage there likely will not be enough coverage for all of the injuries and damage.

That is when it is important that you have underinsured coverage discussed below.

Fact #3: Personal Injury Protection (PIP) Coverage is Required

In Arkansas every insurance policy must offer personal injury protection (PIP) coverage.

PIP coverage includes a minimum of $5,000 for medpay which covers medical bills for any person injured in the wreck, regardless of fault, in an amount up to $5,000.

The legislature found it to be such an important piece of insurance that if a person elects not to purchase PIP coverage they must reject it in writing.

Fact #4: You Should Add Underinsured and Uninsured Coverage to Your Insurance Plan

Underinsured and Uninsured coverage are important pieces of insurance protection, although not required by the State of Arkansas.

Underinsured provides coverage when the other side doesn’t have enough coverage for all of the medical bills and injuries that occurred as a result of their negligence.

Uninsured provides coverage when the other side doesn’t have any insurance for example in a hit and run accident.

It is a mistake to only purchase liability insurance and protect other people from your negligence and fail to purchase underinsured/uninsured coverage to protect yourself from other driver’s negligence.
